In the Matter of DONTIE MITCHELL, Appellant, v. ANTHONY J. ANNUCCI, as Acting Commissioner of Corrections and Community Supervision, Respondent.

DECISION AND ORDER ON MOTION (Index No. 7715-17)

Application for permission to proceed as a poor person and an extension of time to perfect appeal.

Upon the papers filed in support of the application, and no papers having been filed in opposition thereto, it is

ORDERED that the application for permission to proceed as a poor person is granted, without costs, to the extent that the filing fee required by CPLR 8022 is waived and the appeal may be perfected upon the original papers filed in the office of the county clerk, one signed original brief and appendix conforming with rule 1250.8 of the Practice Rules of the Appellate Division, and six copies of the appellant's brief and appendix. Application for an extension of time to perfect the appeal is granted, without costs, and appellant's time to perfect appeal extended to February 11, 2019. It is noted that no further extensions of time to perfect the appeal will be granted absent an unanticipated and extraordinary excuse for the delay.
