BALLOT TITLE CERTIFIED

McCormick v. Myers (S50967). Upon consideration by the court. Petitioner's request for oral argument is denied. Petitioner's arguments that the Attorney General's certified ballot title for Initiative Petition 90 (2004) does not comply substantially with ORS 250.035(2) are not well taken. The court certifies to the Secretary of State the Attorney General's certified ballot title for the proposed measure. McCormick v. Myers (S50968). Upon consideration by the court. Petitioner's request for oral argument is denied. Petitioner's arguments that the Attorney General's certified ballot title for Initiative Petition 91 (2004) does not comply substantially with ORS 250.035(2) are not well taken. The court certifies to the Secretary of State the Attorney General's certified ballot title for the proposed measure. Wyant/Nichols v. Myers (S50490) (S50493). Upon consideration by the court. Petitioners Nichols, Piercy, Bennett, and Fitchett have filed a combined petition for reconsideration of this court's November 28, 2003, decision and objections to the Attorney General's modified ballot title for Initiative Petition 40 (2004). The petition for reconsideration is denied. The objections to the modified ballot title are overruled. The court certifies to the Secretary of State the Attorney General's modified ballot title for Initiative Petition 40 (2004).
