Miranda v. Torres

Supreme Court of Florida
Sep 23, 2010
46 So. 3d 566 (Fla. 2010)

Opinion

Case No. SC10-550.

September 23, 2010.

Lower Tribunal No(s). 3D08-3275, 07-8772.

Because petitioners have failed to show a clear legal right to the relief requested, they are not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000). Respondent's "Request to Add New Information to My Response" is granted. Petitioners' "Motion to Reverse the Lower Court's Dismissal of the Petitioner's Appeal Due to the Respondent's Failure to Serve a Response to Petitioner's Writ of Mandamus" is denied.

CANADY, C.J., and PARIENTE, POLSTON, LABARGA, and PERRY, JJ., concur.
