Jeffrey Pocaro, plaintiff's former lawyer, filed a motion without notifying her seeking leave to appeal from orders dated July 24, 2012 and August 23, 2012 dismissing plaintiff's complaint without prejudice and sanctioning him for being unprepared for trial. On December 18, 2012, we denied that motion. Nevertheless, he now appeals from the same orders despite our December 2012 order.
While this interlocutory appeal was pending, plaintiff's new counsel filed a motion with the judge seeking reconsideration of the July 24, 2012 and August 23, 2012 orders. The judge correctly decided not to hear that motion because of the pending appeal. We then denied plaintiff's motion to supplement the record with two certifications that her current counsel had filed in support of his reconsideration motion.
We now dismiss the appeal as interlocutory, R. 2:2-4, and direct the judge to dispose of plaintiff's reconsideration motion. We do not retain jurisdiction.
