In an action to recover damages for personal injuries, the defendants appeal from an order of the Supreme Court, Richmond County (Mastro, J.), dated September 24, 1998, which denied their motion for summary judgment dismissing the complaint.

Tutoki Goldstick, New York, N.Y. (Daniel I. Hirsch of counsel), for appellants.

Kaufman Feit, LLP, New York, N.Y. (Michael S. Feit of counsel), for respondent.

GUY JAMES MANGANO, P.J., LAWRENCE J. BRACKEN, DANIEL W. JOY, HOWARD MILLER, JJ.

DECISION ORDER

ORDERED that the order is affirmed, with costs.

The Supreme Court properly found that there are issues of fact requiring the denial of summary judgment.
