PRESENT: , J.P., CENTRA, FAHEY, CARNI, AND VALENTINO, JJ.

Respondent-respondent having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on April 24, 2013,

Now, upon reading and filing the affidavit of Katherine D. Warren, sworn to June 18, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the submission of a new motion that includes an affidavit that explains the discrepancies between respondent's affidavit sworn to March 15, 2013, and her affidavit sworn to June 18, 2013, as to her income from child support, supplemental nutrition assistance program benefits, and the number of dependents in her household, and describes respondent's current living arrangements and the method by which she supports herself given her stated income and expenses.
