Action by an employer to recover, by away of subrogation, damages to next of kin of deceased employee resulting from negligent operation of train. Judgment for defendant.

Appeal from the Circuit Court of Winnebago county; the Hon. Arthur E. Fisher, Judge, presiding. Heard in this court at the June term, 1927.
