On January 13, 2022, respondent filed a motion for leave to file first supplement to motion for summary judgment and lodged a copy of the first supplement to motion for summary judgment. On January 13, 2022, respondent filed a motion for leave to file first supplemental declaration of Joseph E. Conley in support of motion for summary judgment and lodged a copy of the first supplemental declaration of Joseph E. Conley in support of motion for summary judgment.

Upon due consideration, it is

ORDERED that respondent's motion for leave to file first supplement to motion for summary judgment is granted, and respondent's first supplement to motion at index no. 32 is filed as of the date of the service of this Order. It is further

ORDERED that respondent's motion for leave to file first supplemental declaration of Joseph E. Conley in support of motion for summary judgment, is granted and respondent's first supplement at index no. 34 is filed as of the date of the service of this Order. It is further

ORDERED that petitioner shall file a response to respondent's motion for summary judgment, as supplemented on or before February 17, 2022.
