March 26, 1943.

Motion for an appeal from the judgment of the Franklin Circuit Court in favor of plaintiff for $50 damages done her lot by reason of dirt washing thereon, and dismissing defendant's counterclaim for $150 damages done his lot by reason of plaintiff's alleged obstruction of the natural flow of surface water.

Liggett B. Armstrong and J.R. Carpenter for movant.

Appeal denied; judgment affirmed.
