Hiram MILES, Appellant v. The STATE of Texas, Appellee

From the 290th Judicial District Court, Bexar County, Texas
Trial Court No. 96-CR-0010
Honorable Sharon S Macrae, Judge Presiding

ORDER

On June 11, 2020, appellant filed a letter requesting a copy of the court's appellate docket sheet and internal operating procedures "for the purpose of researching why a brief was not reviewed by the court" before its opinion issued affirming appellant's conviction. See Miles v. State, No. 04-97-00313-CR, 1999 WL 106989 (Tex. App.—San Antonio Mar. 3, 1999, no pet.) (mem. op., not designated for publication). The opinion states that appellant's counsel filed a brief pursuant to Anders v. California, 386 U.S. 738 (1967), stating there were no non-frivolous grounds for appeal. Our opinion erroneously recited, "No pro se brief was filed." Instead, the appellate record reflects that appellant did file a pro se brief on September 18, 1998 which raised ten points of error. The appellate record also reflects that the State filed an amended brief on January 21, 1999 which addressed each point of error raised in appellant's pro se brief. Therefore, both appellant's pro se brief and the State's amended brief in response were considered by the court before the opinion issued on March 3, 1999.

It is so ORDERED on July 7, 2020.
