Opinion

02-28-2018

Andrew MIERA, Appellant v. The STATE of Texas, Appellee

From the 187th Judicial District Court, Bexar County, Texas
Trial Court No. 2016cr7970
The Honorable Joey Contreras, Judge Presiding

ORDER

The trial court imposed sentence in Cause No. 2016CR7970 on July 12, 2017. Because appellant did not file a motion for new trial, the notice of appeal was due to be filed on August 11, 2017. TEX. R. APP. P. 26.2(a)(1). A motion for extension of time to file the notice of appeal was due on August 26, 2017. TEX. R. APP. P. 26.3. Appellant did not file his notice of appeal until November 9, 2017, and appellant did not file a motion for extension of time. Because appellant did not timely file a notice of appeal, it appears that we lack jurisdiction over this appeal.

We, therefore, ORDER appellant to show cause on or before March 15, 2018 why this appeal should not be dismissed for lack of jurisdiction.

Irene Rios, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 28th day of February, 2018.
