PATRICK MIDDLETON v. THE STATE.


The Honorable Supreme Court met pursuant to adjournment. The following order was passed:

Court of Appeals Case No. A22A0422

The Supreme Court today granted the writ of certiorari in this case as case No. S22G1050.

This case will be assigned to the May 2023 oral argument calendar automatically under Supreme Court Rule 50 (1) (a). Oral argument is mandatory in granted certiorari cases.

This Court is particularly concerned with the following issue or issues:

Did the trial court err in granting petitioner's motion to suppress evidence obtained during a traffic stop on the basis that the officer was not engaged in the lawful discharge of her official duties at the time of the search and subsequent arrest? See OCGA § 40-13-30.

Briefs should be submitted only on these points. See Supreme Court Rule 45.
