The judgment is to be modified by striking so much thereof as dismisses the action and by substituting therefor a declaration that the plaintiff's service in the Massachusetts National Guard before June 30, 1939, did not constitute "employment" within the meaning of the second paragraph of G.L.c. 32, § 60. As so modified, the judgment is affirmed.
