Miami Beach Kennel Club v. Berlin

District Court of Appeal of Florida, First District
Feb 23, 1987
502 So. 2d 1011 (Fla. Dist. Ct. App. 1987)

Opinion

No. BM-76.

February 23, 1987.

An Appeal from a workers' compensation order; John G. Tomlinson, Jr., Deputy Commissioner.

Daniel J. Sullivan, of Gladson Sullivan, Miami, for appellants.

Renee R. Pelzman, of Levine, Busch, Scnepper Stein, Miami, for appellee.

The appealed order erred in awarding temporary total disability benefits for the nine-week period in 1976 during which, claimant testified, he was employed part-time. It is necessary, therefore, to remand for determination of the amount of wages earned during this period. In all other respects, the appealed order is AFFIRMED.

ERVIN, SHIVERS, and ZEHMER, JJ., concur.
