M.H. v. State

Supreme Court of Arkansas
Dec 18, 1997
955 S.W.2d 911 (Ark. 1997)

Opinion

97-1439

Opinion delivered December 18, 1997

APPEAL ERROR — MOTION FOR RULE ON CLERK — GOOD CAUSE FOR GRANTING. — An admission by an attorney for a juvenile defendant that the record was tendered late due to a mistake on his part is good cause to grant a motion for rule on the clerk.

Motion for Rule on the Clerk; granted.

Lewis Littlepage, for appellant.

No response.

The appellant, M. H., has filed a motion for rule on the clerk. His attorney, Lewis W. Littlepage, admits fault for tendering the record late in his client's juvenile delinquency case.

[1] We find that such an error, admittedly made by the attorney here, is good cause to grant the motion. See Hansberry v. State, 318 Ark. 757, 887 S.W.2d 308 (1994). A copy of this opinion will be forwarded to the Committee on Professional Conduct.
