MEMORANDUM OPINION

PER CURIAM

On December 16, 2022, we abated this appeal, suspended appellate deadlines, and remanded the cause to the trial court to confirm that Appellant is indigent and wishes to proceed with this appeal, and if so, for the trial court to appoint replacement appellate counsel. See Tex. R. App. P. 38.8(b)(2).

On January 3, 2023, Appellant's counsel filed a motion for voluntary dismissal and motion to withdraw with Appellant's signature included. See Tex. R. App. P. 42.2(a).

We reinstate this appeal and withdraw this court's December 16, 2022 order. We grant the motion to dismiss. See id. Pursuant to Appellant's voluntary dismissal and signature to consent, we accordingly grant counsel's motion to withdraw. See Tex. R. App. P. 6.5.
