MOTION FOR LEAVE TO FILE OMITTED DOCUMENTS


NOW INTO COURT, through undersigned counsel, come the defendants, Lee Balinas, Shelly G. Gaudreau and Mark Mauer, respectfully requesting leave to file the annexed Statement of Material Facts About Which There is no Genuine Issue and additional letters of customers of Mark Mauer, showing their requests for service from Mr. Mauer and which should have been attached to the Memorandum in Support of the pending Motion for Summary Judgment.

It is in the interest of completion of the file and compliance with the Local and Federal Rules of Civil Procedure that the annexed Statement of Material Facts About Which There is no Genuine Issue should be placed of record.

The filing of these documents will not prejudice the opposition to the Motion for Summary Judgment because the time for response to the Motion has not yet been established by the Court.
