ORDER
This interpleader action was filed June 23, 2008, as a result of adverse claims to life insurance benefits by Defendants Sandra Adamson and Barbara Anderson. Plaintiff Metropolitan Life Insurance Company has deposited into the Registry of the Court the sum of Ten Thousand Five Hundred Sixty Dollars and Eighty-One Cents ($10,560.81) in life insurance benefits, plus applicable interest, payable as a consequence of the death of John Zablocki under the General Motors Life and Disability Program. (Doc. 19).
Defendants have submitted evidence in the form of several letters, signed under oath, and the parties' factual disputes prevent the Court from deciding this case as a matter of law. Accordingly, this matter is hereby set for a bench trial on Tuesday, April 28, 2009 beginning at 9 a.m.
The Court hereby refers this case to mediation to assist the parties in resolving this matter before trial, if possible. Defendants Adamson and Anderson are each ORDERED to send to the Court a letter listing ten dates (weekdays) when they could be available for mediation via telephone before April 28, 2009. Defendants are also ORDERED to provide the telephone numbers at which they can be reached. Such information shall be provided to the Court on or before March 13, 2009. The Court will then appoint a mediator and schedule the mediation, and will notify the parties of the date and time of the telephone mediation.
The Clerk is DIRECTED to serve this Order upon both Defendants via certified mail.
