Opinion

No. 89-1488.

September 26, 1990.

Appeal from the Circuit Court for Broward County; Richard D. Eade, Judge.

Richard L. Jorandby, Public Defender, and Tanja Ostapoff, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Sylvia H. Alonson, Asst. Atty. Gen., West Palm Beach, for appellee.

Both parties agree that the trial court erred in ordering restitution in this case and we therefore remand with instructions to strike from the order placing appellant on probation the condition that he make restitution. In all other respects we affirm.

AFFIRMED IN PART; REVERSED IN PART AND REMANDED.

HERSEY, C.J., and WALDEN and STONE, JJ., concur.
