ORDER
PER CURIAM
Pending before the Court is Appellee's motion to dismiss for lack of subject matter jurisdiction and mootness alleging a live controversy no longer exists between the parties.
It is therefore ORDERED that this case is abated and remanded to the trial court for further proceedings. The trial court is directed to hold an evidentiary hearing to supplement the record and make a determination regarding the trial court's jurisdiction based on events after the notice of appeal was filed. Further, the trial court shall forward its findings to the County Clerk of El Paso County, Texas, on or before September 18, 2023. The County Clerk shall prepare and forward a supplemental clerk's record containing the findings and forward the same to this Court on or before September 18, 2023. Further, the transcript of the hearing shall be prepared, certified and filed with this Court on or before September 18, 2023. This appeal will be reinstated upon the date the complete supplemental clerk's record is filed with this Court.
