JOAN GOTTLIEB MENDELL, Appellant v. LAURENCE SCOTT AND RACHEL CHAPUT, Appellees

On Appeal from the Probate Court No. 1 Harris County, Texas Trial Court Case No. 475348

Panel consists of Justices Kelly, Guerra, and Farris.

MEMORANDUM OPINION

PER CURIAM.

Appellant Joan Gottlieb Mendell has filed an unopposed motion to dismiss this interlocutory appeal of the trial court's order denying her motion to dissolve a temporary injunction. In her motion, Mendell states that the trial court has issued a final judgment and order granting permanent injunctive relief in the underlying case, rendering this interlocutory appeal moot. See Hernandez v. Ebrom, 289 S.W.3d 316, 319 (Tex. 2009) ("Appeals of some interlocutory orders become moot because the orders have been rendered moot by subsequent orders."); Richards v. Mena, 820 S.W.2d 372, 372 (Tex. 1991) (entry of final judgment renders moot questions regarding validity of previously executed temporary injunction). No opinion has issued in this interlocutory appeal. See TEX. R. APP. P. 42.1(c).

Accordingly, we grant Mendell's motion and dismiss this interlocutory appeal, with costs taxed against the party incurring same. See TEX. R. APP. P. 42.1(a)(1), 43.2(f). The dismissal of this interlocutory appeal is without prejudice to Mendell's already perfected appeal of the final judgment and order granting permanent injunctive relief. See Richards, 820 S.W.2d at 372.

Mendell's appeal from the final judgment and order granting permanent injunctive relief is pending in this Court in Cause No. 01-20-00578-CV.
