ORDER

On May 20, 2008, the United States Magistrate Judge issued an Order and Report and Recommendation recommending that petitioner's motion for default judgment be denied. Doc No. 83. Although the parties were advised of their right to object to the Report and Recommendation, and of the consequences of their failure to do so, there has nevertheless been no objection to the Report and Recommendation.

Accordingly, the Report and Recommendation, Doc. No. 83, is ADOPTED and AFFIRMED. Petitioner's motion for default judgment, Doc. No. 82, is DENIED.
