ANTONIO LEBARON MELTON Petitioner(s) v. STATE OF FLORIDA Respondent(s)

Lower Tribunal No(s).: 1D19-1286; 171991CF001219XXXBXX

Upon review of the response to this Court's Order to Show Cause dated November 30, 2022, the Court has determined that it should decline to exercise jurisdiction in this case. See Morgan v. State, 350 So.3d 712 (Fla. 2022). The petition for discretionary review is, therefore, denied.

Respondent's "Motion to Dismiss the Appeal Based on the Concurrent Sentencing Doctrine" and "Renewed Motion to Dismiss the Appeal" are hereby denied as moot.

No motion for rehearing will be entertained by the Court. See Fla. R. App. P. 9.330(d)(2).

MUÑIZ, C.J., and CANADY, COURIEL, GROSSHANS, and FRANCIS, JJ., concur.

POLSTON and LABARGA, JJ., dissent.

HON. JAN SHACKELFORD, JUDGE
