Order, Supreme Court, New York County, entered on July 14, 1970, unanimously affirmed, without costs and without disbursements. Inasmuch as there is a question of law involved in this appeal which ought to be reviewed by the Court of Appeals, the motion made by the third-party defendant-appellant during argument of this appeal for leave to appeal to the Court of Appeals in the event this court should affirm the order of Special Term is granted. No opinion.
