Two Motions are pending before the Court, the Commissioner's Motion for Continuance filed January 12, 2024, and the Commissioner's Motion to Withdraw his Motion for Continuance, filed January 22, 2024. By Order served January 18, 2024, the Court set the Motion for Continuance for hearing. Both motions recite that the Commissioner attempted to contact Mr. Mejia but Mr. Mejia did not respond. For the reasons stated in the Commissioner's Motion to Withdraw, it is

ORDERED that the Commissioner's Motion to Withdraw, filed January 22, 2024, is granted, and the Commissioner's Motion for Continuance filed January 12, 2024, is deemed withdrawn. It is further

ORDERED that the Court's Order served January 18, 2024, is vacated. This case remains on the January 29, 2024, trial session of the Court commencing at 10:00 am at the Sandra Day O'Connor U.S. Courthouse, 401 West Washington St., Room 406, 4th Floor, Phoenix, AZ 85003.
