CONFESSION OF JUDGMENT, § 53vacation, note signed only as witness. Confession judgment against defendant on note was properly vacated, where evidence showed that defendant could not read or write English and that he was told he was merely signing note as a witness, and plaintiff could not object to instructions where record did not show that there was any objection to the instructions as given before the jury retired.

Appeal from Municipal Court of Chicago; Hon. FRANK M. PADDEN, presiding.

Affirmed. Heard in third division, first district, this court at December term, 1940.
