Opinion

CHARLES R. MEEKER, dba THE MEEKER VINEYARD, Plaintiff, v. MARTIN MEEKER, AHLGREN VINEYARD, PELICAN RANCH WINERY, SANTA CRUZ MOUNTAIN VINEYARD, SAVANNAH-CHANELLE VINEYARDS, and DOES 1 through 10, inclusive, Defendants. No. C 02-00741 JSW United States District Court, N.D. California. November 8, 2004

ORDER GRANTING PLAINTIFF'S MISCELLANEOUS ADMINISTRATIVE REQUEST

          JEFFREY S. WHITE, Judge.

The Court has received Plaintiff's Miscellaneous Administrative Request to consider newly produced evidence in support of Plaintiff's motion for reconsideration and motion for leave to amend the complaint.

The Court has reviewed Plaintiff's supplemental submissions and has determined that it does not need a response from the Defendants regarding the request. At the hearing on the motions, the Court advised Plaintiff it would consider additional electronic mail messages in connection with the motion for reconsideration. Additional argument from the Defendants regarding Plaintiff's position on this evidence would not prove useful.

Accordingly, Plaintiff's Miscellaneous Administrative Request to Consider additional evidence in support of the motion for reconsideration and the motion for leave to amend is GRANTED.

         IT IS SO ORDERED.
