Appellant David Medrano and appellees Fidelity National Title Insurance Company, Successor by Merger with Lawyers Title Insurance Corporation, and Deutsche Bank National Trust Company, as Trustee under Pooling and Servicing Agreement Dated as of June 1, 2007 Securitized Asset Backed Receivables LLC Trust 2007-BR5, have filed motions to dismiss with prejudice the appeal against these parties pursuant to a settlement agreement. We grant the motion and we dismiss Medrano's appeal against Fidelity National and Deutsche Bank with prejudice. Because neither motion discloses an agreement of the parties regarding the assessment of costs, costs are assessed against appellant. See TEX. R. APP. P. 42.1(d) (absent agreement of the parties, costs are taxed against appellant).

David Medrano's appeal against Celine Hinojosa remains pending. See TEX. R. APP. P. 42.1(b).
