ORDER

PER CURIAM

This cause is before the Court on appellant's fifth motion for extension of time to file appellant's brief. Appellant's brief was originally due on August 9, 2023. After four previous extensions, we ordered appellant's brief to be filed on or before 5:00 p.m. on December 11, 2023.

However, the Court, having fully considered appellant's current motion and motions for extension of time to file the brief previously granted in this case, is of the opinion that for good cause, and in the interest of justice, appellant's amended fifth motion for extension of time to file the brief should be granted with order.

Accordingly, appellant's amended fifth motion for extension of time to file the brief is hereby GRANTED. IT IS THEREFORE ORDERED that the Honorable Kurt Hopke, counsel for appellant, file appellant's brief with this Court on or before 5:00 p.m. on January 10, 2024. FURTHER MOTION FOR EXTENSION OF TIME WILL NOT BE VIEWED FAVORABLY ABSENT NEW AND EXIGENT CIRCUMSTANCES.
