ORDER OF DISMISSAL

TRINA L. THOMPSON UNITED STATES DISTRICT JUDGE.

Plaintiff is a state prisoner proceeding pro se and in forma pauperis in this civil rights action pursuant to 42 U.S.C. § 1983. Plaintiff's first amended complaint (ECF 18) was dismissed, and plaintiff was directed to file a second amended complaint on or before December 11, 2023. ECF 21. That date has now passed, and plaintiff has neither filed an amended complaint nor sought an extension of time to do so. Due to plaintiff's failure to comply with a court order and failure to prosecute, this case is DISMISSED without prejudice.

IT IS SO ORDERED.
