McKim v. Hurley Medical Center

Supreme Court of Michigan
Oct 26, 1999
603 N.W.2d 781 (Mich. 1999)

Opinion

No. 112741.

October 26, 1999.

On order of the Court, the application for leave to appeal from the July 9, 1998, decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

We would MODIFY the January 9, 1998, judgment of the Workers' Compensation Appellate Commission to the extent it denies benefits and would REMAND the matter to the magistrate for reconsideration of the plaintiff's claim on the existing record under the correct legal standard. Specifically, we would direct the magistrate to decide whether employer discipline contributed to the plaintiff's disabling condition in a significant manner.

Court of Appeals No. 209434.
