On order of the Court, the application for leave to appeal from the February 19, 1999, decision of the Court of Appeals is considered. The application is DISMISSED as moot. Despite the apparent jurisprudential significance of this case, which otherwise would prompt the Court to grant leave to appeal, we have been informed that the plaintiffs have sold the property in question and have sought to withdraw their petition to open a private road.

Cavanagh, J., would grant leave to appeal.
