It is ordered and adjudged by this court that the judgment of the said Court of Appeals be, and the same is hereby, affirmed on authority of State, ex rel. Bryson, v. Smith, Secy. of State, 101 Ohio St. 203, and State, ex rel. Day, State Treas., v. Emmons et al., State Civil Service Comm., 126 Ohio St. 19.

Judgment affirmed.
