ORDER DISMISSING APPEAL


Upon review of the record it appears that: (1) on September 3, 2003, the supreme court clerk's office informed Appellant Henry K. McKeague that the record cannot be filed without payment of the filing fee pursuant to HRAP Rule 3(f) or an executed motion to proceed in forma pauperis pursuant to HRAP Rule 24 and that the matter would be brought to the attention of the court on September 10, 2003 for such action as the court deems appropriate, which includes dismissal of the appeal; and (2) Appellant did not pay the filing fee or obtain leave to proceed in forma pauperis. Therefore,

IT IS HEREBY ORDERED that the appeal is dismissed.
