ORDER

TIMOTHY D. DEGIUSTI, CHIEF UNITED STATES DISTRICT JUDGE.

Upon review of the file and noting no timely objectionto the findings and recommendations of United States Magistrate Judge Suzanne Mitchell pursuant to 28 U.S.C. § 636(b)(1), the Court adopts the Report and Recommendation [Doc. No. 7] in its entirety.

Petitioner mailed a copy of the Report and Recommendation back to the Court on September 19, 2023 [Doc. No. 8], but there were no objections-or anything other than the Report and Recommendation itself-included in the mailing.

For the reasons stated therein, Petitioner's “Affidavit In Forma Pauperis” [Doc. No. 3] is DENIED. If Petitioner's filing fee is not received by the Clerk of Court within twenty-one (21) days of this Order, this action will be dismissed without prejudice.

IT IS SO ORDERED.
