MINUTE ENTRY


IS ORDERED that the motion to dismiss for failure to state a claim upon which relief can be granted filed by Michael Haight is GRANTED based onHeck v. Humphrey, 114 S.Ct. 2364 (1994). No opposition has been filed by the plaintiff, who is represented by counsel.

IT IS FURTHER ORDERED that the motion to dismiss filed by Scott M. Perrilloux is GRANTED based on Heck v. Humphrey, 114 S.Ct. 2364 (1994). Again, no opposition has been filed by the plaintiff, who is represented by counsel.

IT IS FURTHER ORDERED that the motion for sanctions Scott M. Perrilloux is DENIED. Although counsel for the plaintiff has not filed an opposition, the Court determines that sanctions are not warranted.
