FORECLOSURE OF MORTGAGES, § 219nonliability of one of defendants for deficiency. In action to foreclose trust deeds securing certain promissory notes, held that, under law and facts, one of defendants, against whom decree for deficiency was entered, was not liable therefor.

Appeal from Circuit Court of Cook county; Hon. PHILIP J. FINNEGAN, presiding.

Decree of December 23, 1940, reversed in toto; decree of November 8, 1940, in so far as it adjudges appellant liable for a deficiency, reversed. Heard in second division, first district, this court at April term, 1941.
