ORDER DISMISSING ACTION WITHOUT PREJUDICE


On June 7, 2004, the Court denied plaintiff Hermon R. McDowell's ("McDowell") request to proceed in forma pauperis, and ordered him to pay the requisite filing fee no later than July 1, 2004. McDowell has not done so.

Accordingly, the above-entitled action is hereby DISMISSED, without prejudice.

The Clerk shall close the file.

IT IS SO ORDERED.
