ORDER

Before the Court is the February 9, 2018 second request of Official Court Reporter Kimberly Xavier for an extension of time to file the reporter's record. The record was due on December 9, 2017. On December 12, 2017, the Court granted Ms. Xavier an extension until January 8, 2018. When the reporter's record was not filed by the extended due date, the Clerk notified Ms. Xavier and directed her to file the record within thirty days. The reporter's record has not been filed.

We GRANT Ms. Xavier's request and extend the time to file the reporter's record until February 26, 2018.

If Ms. Xavier fails to file the record by February 26, 2018, the Court may utilize its available remedies, including ordering that she not sit until the complete reporter's record is filed.

We DIRECT the Clerk to send copies of this order, by electronic transmission, to the Honorable Gracie Lewis, Presiding Judge, Criminal District Court No. 3; to Kimberly Xavier, official court reporter, Criminal District Court No. 3; and to counsel for the parties.
