Opinion

No. 94-2049.

August 30, 1995.

Appeal from the Circuit Court for Broward County; Patti Englander Henning, Judge.

John Beranek of Macfarlane Ausley Ferguson McMullen, Tallahassee, and Jon E. Krupnick of Campbell Malone Roselli Buser Slama, Fort Lauderdale, for appellants.

Philip D. Parrish of Stephens, Lynn, Klein McNicholas, P.A., Miami, for appellees.

Because of this court's reversal of summary judgments as to all but one appellee in McDonald v. Florida Department of Transportation (DOT), et al., 655 So.2d 1164 (Fla. 4th DCA 1995), we now reverse the summary judgment in favor of Bergeron. We remand for further proceedings consistent with the opinion in McDonald v. DOT.

STONE, POLEN and FARMER, JJ., concur.
