ADRIAN ROOSEVELT MCDANIEL, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court Dallas County, Texas
Trial Court Cause No. F14-57440-H

ORDER

The Court REINSTATES the appeal.

On December 3, 2015, we ordered the trial court to make findings regarding why the reporter's record had not been filed. We also ordered the trial court to prepare and file a certification of appellant's right to appeal. On February 11, 2016, we received the reporter's record. However, the court reporter did not file State's Exhibit nos. 41 and 42, CDs, with the record. Additionally, the trial court has not filed the certification of appellant's right to appeal.

We ORDER the reporter's record received on February 11, 2016 filed as of the date of this order.

We ORDER the trial court to file with this Court, within TEN DAYS of the date of this order, a certification of appellant's right to appeal that accurately reflects the trial court proceedings. See TEX. R. APP. P. 25.2(a), (d); Cortez v. State, 420 S.W.3d 803 (Tex. Crim. App. 2013).

We DIRECT the Clerk to send copies of this order to the Honorable Robert Burns, Presiding Judge, Criminal District Court, and to counsel for all parties.
