Pro Se Petition for Writ of Mandamus [Circuit Court of Craighead County, Western District, CR 2004-820], Petition Moot.


On August 18, 2010, petitioner Walter A. McCullough filed a pro se petition for writ of mandamus in this court. He contended in the petition that the Honorable Victor Hill, Circuit Judge, had failed to act in a timely manner on a petition to vacate or modify judgment filed on May 28, 2010, in the Circuit Court of Craighead County, Western District.

Respondent Hill has filed a response to the mandamus petition with a copy appended to it of an order entered on August 30, 2010, that disposes of the petition filed May 28, 2010. As the court has acted on the petition, the petition for writ of mandamus is moot. Strong v. Thyer, 2010 Ark. 19 (per curiam); Cummings v. Proctor, 2009 Ark. 588 (per curiam).

Petition moot.
