The parties have represented to the Magistrate Judge that they have reached a settlement in this case. The Trial, currently scheduled for November 9, 2009, is hereby VACATED. The Court further ORDERS that a dismissal shall be filed on or before November 12, 2009. If the case has not been dismissed by that date, the Court shall schedule a status conference.
