ORDER DENYING PLAINTIFF'S MOTION TO AMEND IN LIGHT OF TESTIMONY AT SPEARS HEARING


This matter comes before the court on the October 22, 2007, motion of the plaintiff to amend his complaint to include a claim of racial discrimination. At the Spears hearing in this case, however, the plaintiff testified that there was no racial issue involved in the case. As such, the instant motion to amend the complaint to include an allegation of racial discrimination is hereby DENIED.

SO ORDERED.
