MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant appeals from a summary process judgment in favor of the plaintiff for possession of the premises, thirty dollars in unpaid rent, and associated costs. The judge found that the defendant vacated the premises with an unpaid rent balance of thirty dollars, and that the defendant failed to present any credible evidence to support any defenses or claims in his answer. The defendant has not improved his position on appeal, as he has not provided a transcript of the proceeding, and his brief and record appendix fail to comply with the rules of appellate procedure. See Mass.R.A.P. 8(b)(1), as amended, 430 Mass. 1603 (1999); Mass.R.A.P. 16(a)(4), as amended, 367 Mass. 921 (1975); and Mass.R.A.P. 18(a), as amended, 425 Mass. 1602 (1997). Even putting those procedural mishaps aside, it has not been made to appear there was any error in the judgment.

Judgment affirmed.
