Defendant Kelly Kasperski having moved to dismiss the appeal taken herein from an order of the Cattaraugus County Court entered in the Office of the Clerk of the County of Cattaraugus on February 8, 2018, on the ground that appellant failed to perfect timely the appeal, or due to a jurisdictionally defective notice of appeal,

Now, upon reading and filing the affirmation of Matthew D. Pfalzer, Esq., dated June 4, 2018, and the notice of motion with proof of service thereof,

It is hereby ORDERED that the motion as it relates to defendant Kelly Kasperski is granted, and the appeal is dismissed without costs (see 22 NYCRR 1000.12 [a]).
