Proceeding pursuant to section 298 Exec. of the Executive Law to review a determination of the State Human Rights Appeal Board, dated October 2, 1970, which dismissed, for lack of jurisdiction, an appeal by petitioner from an order of the Commissioner of the State Division of Human Rights dated June 15, 1970. Petition dismissed on the merits and determination confirmed, without costs. The appeal from the order of the Commissioner was not timely (Executive Law, § 297-a, subd. 6, par. c). Therefore, the Appeal Board was without jurisdiction to review the appeal. Rabin, P.J., Munder, Martuscello, Shapiro and Gulotta, JJ., concur.
