Matter of Vischer

Appellate Division of the Supreme Court of New York, First Department
Jan 30, 1951
278 App. Div. 565 (N.Y. App. Div. 1951)

Opinion

January 30, 1951.

Order unanimously affirmed, with $20 costs and disbursements. No opinion.

Present — Peck, P.J., Cohn, Callahan, Van Voorhis and Shientag, JJ.;

I concur for affirmance. I construe the words "pendente lite" as used in the order appealed from to mean pending the entry of a decree admitting to probate the will dated April 13, 1949, or denying such relief. [Order granted temporary injunction.]
