Appellate Division of the Supreme Court of New York, Third Department
Nov 18, 1942
265 App. Div. 895 (N.Y. App. Div. 1942)

Opinion

November 18, 1942.

Present — Hill, P.J., Crapser, Bliss, Schenck and Foster, JJ.

The claimants are the widow and children of William G. Virrill, deceased, who during his life worked for the employer as an automobile salesman. The injuries which caused death were received while Virrill was teaching a customer to drive an automobile he had sold on behalf of the employer. The proof sustains the findings that the deceased was working for the employer when injured. Award unanimously affirmed, with costs to the State Industrial Board.
