Appellate Division of the Supreme Court of New York, Second Department
Oct 8, 1951
279 App. Div. 595 (N.Y. App. Div. 1951)

Opinion

October 8, 1951.

In a condemnation proceeding, the owner of the subject real property appeals from so much of an order which was made upon reargument of a previous motion as denies the owner's motion to settle a proposed case on appeal from the final order made in the proceeding, and directs the case to be settled by adding thereto certain minutes, stipulations, memorandum decision and orders. Order, insofar as appealed from, affirmed, with $10 costs and disbursements. No opinion. Carswell, Acting P.J., Adel, Sneed, Wenzel and MacCrate, JJ., concur.
